By using the services (“Services”) provided by Underdog Solutions, Clients/Customers agree to comply with this Acceptable Use Policy (AUP) and to indemnify Underdog Solutions against any claims arising from violations of this Policy, in accordance with the Underdog Solutions Master Service Agreement.
Clients/Customers must comply with all terms of their agreements with Underdog Solutions at all times. If a Client/Customer is found to be non-compliant, Underdog Solutions will provide written notice. If the issue is not corrected within 24 hours, Underdog Solutions may immediately suspend services, including but not limited to website hosting, email hosting, performance of services, or pending deliverables.
In such cases, Underdog Solutions will not be liable for incidental, indirect, special, or consequential damages of any kind, including without limitation loss of profits, savings, or revenues, or claims from third parties.
Hosting Terms – Unless otherwise negotiated, hosting services are billed annually. Payments are non-refundable. Early cancellations do not qualify for partial refunds or credits.
Money Back Guarantee – Underdog Solutions provides a limited money-back guarantee on new hosting accounts. If services do not meet industry standards for performance and reliability within the first 72 hours, a refund will be issued for hosting fees only (excluding setup or hourly support fees).
Final Payments – In all other cases, payments are final and non-refundable.
Clients/Customers agree to interact with Underdog Solutions in a respectful and professional manner. This includes respecting staff time, honoring scheduled calls/meetings, and conducting communications in a courteous tone. Repeated violations of this standard, after notice, may result in termination of services.
Clients/Customers assume all responsibility for:
Their business activities and online content.
Data provided to or hosted by Underdog Solutions.
Security of systems used to access services.
Compliance with applicable laws and regulations.
Activities of their end users in connection with Underdog Solutions services.
Clients/Customers and their affiliates may not engage in the following:
Attempting unauthorized access to servers or services.
Phishing, password theft, port scanning, or testing vulnerabilities without authorization.
Introducing malware, viruses, worms, or other harmful code.
Forging or misrepresenting transmission information.
Using IP addresses not assigned by Underdog Solutions.
Running unauthorized bots, clients, or IRC servers.
Accounts may be terminated if they host or link to content that:
Is unlawful or promotes unlawful activity.
Promotes harm, violence, or exploitation.
Infringes on intellectual property rights.
Violates any statute, ordinance, or regulation (including consumer protection, privacy, data transfer, export control, etc.).
Underdog Solutions enforces a zero-tolerance spam policy. Clients/Customers may not:
Send unsolicited commercial email (UCE).
Host or promote content distributed via spam.
Allow open relays or insecure scripts that could be exploited for spam.
Violations may result in suspension or termination of services. A $500 minimum fee may apply for investigation/resolution of spam-related complaints.
To facilitate hosting and server management, Underdog Solutions maintains administrative access accounts and software. Clients/Customers may not tamper with or interfere with these tools. Doing so is grounds for immediate suspension or termination.
Underdog Solutions reserves the right to refuse service or terminate accounts at any time, without prior notice, for violations of this AUP. Payments are non-refundable in such cases.
Should a Client/Customer request transfer of their website code or hosting to a third party, Underdog Solutions requires a signed Release of Liability prior to releasing files or providing administrative access.
Underdog Solutions reserves the right to charge investigation, resolution, or cleanup fees related to AUP violations. The minimum fee is $500, with additional hourly charges applied if necessary.
Underdog Solutions may update this AUP at any time without prior notice. Updated policies will be posted on our website and are effective immediately upon posting. Clients/Customers are responsible for reviewing this AUP regularly. Continued use of services constitutes acceptance of changes.
Underdog Solutions recognizes that no one owns or controls the Internet. While we do not actively monitor client activity, we expect all Clients/Customers to use our Services responsibly, ethically, and in compliance with this AUP.
